As part of our effort to provide help and assistance to all of our clients, friends, and family in the areas affected by Hurricane Harvey, we wish to inform you of the fact that in this year’s legislative session, the Texas Legislature passed—and Governor Abbott signed into law—a Bill that substantively affects (and limits) Texas property owners’ rights and abilities to recover for weather-related damages to insured property.
If you have, or think you may have, property damage related to Hurricane Harvey and intend to make an insurance claim for it, providing notice to your property insurance carrier in writing before midnight Thursday (8/31/2017) will help you retain some of the protections currently available to you under the Texas Insurance Code that will no longer be available as of 12 a.m. Friday (9/1/2017) morning.
To assist you with the claims process, you can click this link: LINK for a blank “Written Notice of Claim” form that you can fill out, save, and submit to your insurance company to notify them of your claim prior to the legislation’s effective date noted above.
Your insurance agent can also assist you with this process, and many carriers have online portals that allow you to submit claims electronically as well. Make sure you receive a claim number and also save/screenshot/etc. some form of proof to demonstrate the date and time you filed your claim.
